Terms and Conditions

  • General

    • Applicability
      These Terms and Conditions ("Terms") govern all contracts for the provision of services by mDataPartners ("the Company" or "the Supplier") to the Customer. These Terms shall take precedence over any conflicting terms in the Customer’s documentation or communications.
    • Amendments
      No modification to these Terms shall be effective unless agreed upon in writing and signed by an authorized representative of mDataPartners.

  • Pricing & Payment

    Payment may be made via wire transfer, credit card, or approved payment gateways. Full payment (100%) is required in advance before the Supplier delivers the requested products or services.

  • Delivery Timeline

    Upon order confirmation, mDataPartners will make every effort to ensure prompt delivery. Electronic deliverables (e.g., PDF, Word, or Excel documents) are typically transmitted within 24–48 working hours of purchase via email, unless otherwise specified in a Contract or Service Level Agreement (SLA).

  • Customer Obligations

      The Customer shall:
    • Cooperate fully with the Supplier in the execution of services.
    • Provide any necessary information reasonably requested by the Supplier.
    • Maintain accurate and updated contact details (name, postal address, phone, fax, and email).
    • Adhere to all applicable laws and regulations, particularly concerning data protection and confidentiality.

  • Supplier Obligations

    • The Supplier shall perform services with reasonable skill, care, and professionalism, adhering to industry standards and best practices.

  • Cancellation, Returns & Refund Policy

    Due to the digital and knowledge-based nature of our products and services—which include critical market information delivered in electronic, downloadable formats—all sales are final. Once purchased, no cancellations, returns, or refunds will be permitted, as immediate access to the content is granted upon payment.

  • Force Majeure

    Neither party shall be held liable for any delay or failure in fulfilling its obligations if such delay or failure arises from events beyond its reasonable control, including but not limited to:
    • Acts of God (natural disasters)
    • War, terrorism, or civil unrest
    • Strikes, labor disputes, or government actions
    • Fire, floods, or other catastrophic events
    • Unforeseen supply chain disruptions

    In such cases, the affected party shall be granted a reasonable extension to perform its obligations, provided it promptly notifies the other party of the delay.

  • Copyright & Intellectual Property

    All deliverables—including research reports, proposals, questionnaires, sample pages, and survey materials—remain the exclusive property of mDataPartners and are provided for the Customer’s internal use only.
    • The Customer agrees NOT to:
    • Reproduce, modify, or distribute any materials without prior written consent from mDataPartners.
    • Share, resell, or disclose purchased content to unauthorized parties (electronically or physically).
    • Use deliverables in any manner not expressly permitted under this agreement.
    Any violation of these terms may result in legal action and termination of service.

  • Governing Law & Jurisdiction

    • These Terms & Conditions, along with any disputes arising from them, shall be governed by the laws of Maharashtra, India.
    • Both parties agree to exclusive jurisdiction in the courts of Maharashtra, India, and expressly consent to legal proceedings in this jurisdiction.
    • No waiver of rights shall be implied by any delay or failure to enforce a provision.
    • If any clause is deemed invalid or unenforceable, the remaining terms shall remain in full effect.
